حَدَّثَنَا إِسْحَاق بْنُ مُوسَى الْأَنْصَارِيُّ، حَدَّثَنَا مَعْنٌ، حَدَّثَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنْ ابْنِ عُمَرَ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الشِّغَارِ . قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ عَامَّةِ أَهْلِ الْعِلْمِ لَا يَرَوْنَ نِكَاحَ الشِّغَارِ، ‏‏‏‏‏‏وَالشِّغَارُ أَنْ يُزَوِّجَ الرَّجُلُ ابْنَتَهُ عَلَى أَنْ يُزَوِّجَهُ الْآخَرُ ابْنَتَهُ أَوْ أُخْتَهُ، ‏‏‏‏‏‏وَلَا صَدَاقَ بَيْنَهُمَا، ‏‏‏‏‏‏وقَالَ بَعْضُ أَهْلِ الْعِلْمِ:‏‏‏‏ نِكَاحُ الشِّغَارِ مَفْسُوخٌ، ‏‏‏‏‏‏وَلَا يَحِلُّ وَإِنْ جُعِلَ لَهُمَا صَدَاقًا، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ الشَّافِعِيِّ، ‏‏‏‏‏‏وَأَحْمَدَ، ‏‏‏‏‏‏وَإِسْحَاق، ‏‏‏‏‏‏وَرُوِيَ عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ، ‏‏‏‏‏‏أَنَّهُ قَالَ:‏‏‏‏ يُقَرَّانِ عَلَى نِكَاحِهِمَا وَيُجْعَلُ لَهُمَا صَدَاقُ الْمِثْلِ، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ أَهْلِ الْكُوفَةِ.
