Sunan Abu Dawood 4458

حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ حَدَّثَنَا أَبَانٌ ، ‏‏‏‏‏‏عَنْ قَتَادَةَ ، ‏‏‏‏‏‏عَنْ خَالِدِ بْنِ عُرْفُطَةَ ، ‏‏‏‏‏‏عَنْ حَبِيبِ بْنِ سَالِمٍ ، ‏‏‏‏‏‏أَنَّ رَجُلا يُقَالُ لَهُ:‏‏‏‏ عَبْدُ الرَّحْمَنِ بْنُ حُنَيْنٍ وَقَعَ عَلَى جَارِيَةِ امْرَأَتِهِ، ‏‏‏‏‏‏فَرَفَعَ إِلَى النُّعْمَانِ بْنِ بَشِيرٍ وَهُوَ أَمِيرٌ عَلَى الْكُوفَةِ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ لأَقْضِيَنَّ فِيكَ بِقَضِيَّةِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ،‏‏‏‏ إِنْ كَانَتْ أَحَلَّتْهَا لَكَ جَلَدْتُكَ مِائَةً، ‏‏‏‏‏‏وَإِنْ لَمْ تَكْنُ أَحَلَّتْهَا لَكَ رَجَمْتُكَ بِالْحِجَارَةِ . فَوَجَدُوهُ أَحَلَّتْهَا لَهُ فَجَلَدَهُ مِائَةً. قَالَ قَتَادَة:‏‏‏‏ كَتَبْتُ إِلَى حَبِيبِ بْن سَالِمٍ فَكَتَبَ إِلَيَّ بِهَذَا.

Narrated An-Numan ibn Bashir: Habib ibn Salim said: A man called Abdur Rahman ibn Hunayn had intercourse with his wife's slave-girl. The matter was brought to an-Numan ibn Bashir who was the Governor of Kufah. He said: I shall decide between you in accordance with the decision of the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم. If she made her lawful for you, I shall flog you one hundred lashes. If she did not make her lawful for you, I shall stone you to death. So they found that she had made her lawful for him. He, therefore, flogged him one hundred lashes. Qatadah said: I wrote to Habib bin Salim; so he wrote this (tradition) to me.
